Working while studying: know your rules and your rights

The line between what your visa allows and what your employer owes you.

Two separate things

Your visa limits come from the immigration rules: how many hours you may work in a period, and when you may begin. These limits change, so check the current condition on your own visa.

Your workplace rights come from Australian workplace law and apply to everyone, whatever their visa: minimum pay, a payslip, a safe workplace, and protection from being underpaid or exploited.

The common trap

The trap is being paid cash below the minimum rate, told it is normal for students, and asked not to ask questions. It is not normal and it is not legal.

Keep your own record of hours and pay, whatever your employer does. If the numbers do not match, you have the evidence to ask, and the Fair Work Ombudsman can help for free.

Do it properly

Give your employer your tax file number and your bank details, so your pay is on the books and your super is paid. Check your payslip each time.

Immigration rules and pay rates both change. Verify the current figures with the official sources before relying on them.

The one thing to take away

Your visa sets your limits; the law sets your rights — and they are independent.

Always check the official source. Rates, fees and rules change.
