Terms of service

The rules for using the Bhutan Super App. Written to be read rather than skimmed past, if anything here is unclear, ask the operator before you rely on it.
What this platform is
The Bhutan Super App is a marketplace. It connects people who have something to offer with people who want it. It is not a party to any deal made through it.
When you agree a sale, a booking, a rental or a service with another account, that agreement is between the two of you. The platform provides the listing, the messaging, the booking record and the fee calculation. It does not buy, sell, own, inspect, deliver or guarantee anything listed.
Your account
You need an account to list, message, book or review. Give accurate details and keep them current.
You are responsible for what happens under your account. Keep your password to yourself, and tell the operator if you think someone else has it.
One person or business, one account. Accounts that duplicate, impersonate or automate are removed.
You must be old enough to enter a contract where you live, and at least 13 years old in any case.
Listing on the platform
You keep ownership of what you post. By posting it you give the platform permission to display it, promote it and include it in search results.
Everything you list must be legal to sell or offer where it sits, accurately described, and genuinely available. You must have the right to sell or let what you list, especially property, land and vehicles.
Listings are checked automatically for completeness and for implausible prices. Most publish on their own; anything that fails the check goes to a person instead.
The operator can remove or pause a listing that breaks these terms, that has been reported, or that appears fraudulent. You will be told when that happens.
Not allowed
Anything unlawful, stolen, counterfeit, or that you do not have the right to sell.
Weapons, drugs, wildlife and protected items, human trafficking or labour exploitation in any form, and any service that facilitates them.
Impersonating another person or business, or misrepresenting what you are offering.
Fraud, pressure selling, circulating false reviews, or using the platform to move money that is not payment for a genuine listing.
Harvesting other people's contact details, scraping the platform, or automating it without permission.
Payments
Money moves directly between the buyer and the seller, over mBoB, eTeeru, in the local currency, or in person. The platform never holds the funds and never takes a cut of the transfer.
Buyers and sellers confirm payments between themselves. When a seller confirms that money has arrived, the platform records the transaction and works out its commission.
Deal only through the platform's own messaging until you are confident, and never send money for something you have not satisfied yourself exists.
Fees
Listing is free. Running a business profile is free.
The platform charges a 5% commission on a confirmed sale, and only in the commercial categories it processes itself: hotels, homestays, tourism experiences, tours, guides and selected products. Land, property, cars and basic business listings are free to list in Phase 1. Education is free to list and free to sell in Phase 1, and jobs carry no transaction through the platform, so both are free.
Optional growth plans (promoted listings, subscriptions and commissioned services) are priced openly on the fees page, are opt-in, and are never required in order to trade.
Any fee change applies to future sales, not to sales already confirmed.
Bookings and cancellations
A booking is a request. It becomes an agreement when the other party accepts it.
Cancellations and refunds are settled between the two parties. The platform records what was requested and what was decided, and can be asked to review a dispute, but it does not refund money it never held.
Reviews
Reviews must come from genuine dealings and describe your own experience. Fake, paid-for or retaliatory reviews are removed.
What the platform is responsible for
The platform is responsible for running the marketplace: publishing listings, delivering messages, recording bookings and reviews, and calculating fees honestly.
The platform is not responsible for the conduct of other users, for the quality, safety or legality of what is listed, or for a deal that goes wrong between two accounts. You use the marketplace at your own judgement.
Where the law does not allow a limit like this, the platform's responsibility is limited to the greatest extent that law permits.
If something goes wrong
Raise it with the other party first through the platform's messaging, so the record sits in one place.
If that does not resolve it, report it to the operator. Reports are recorded and reviewed, and the outcome is noted against the transaction.
Suspension and closure
The operator can suspend or close an account that breaks these terms, that is being used fraudulently, or where the law requires it. Where it is reasonable to do so, the account holder is told why.
You can close your own account at any time. Records of confirmed transactions and the fees on them are kept after closure as financial records.
Changes to these terms
These terms may change as the platform grows across new markets. The date at the top changes with them, and continuing to use the platform means you accept the current version.
Which law applies
These terms are governed by the laws that apply where the platform operator is established. Nothing here removes a consumer protection you are entitled to under the law of the country you live in.
